Background and effectiveness of the General Conditions

These general terms and conditions of sale (hereinafter, “General Terms and Conditions“) have as their object the regulation of the purchase of products and services, made at a distance and made available, through the Internet network, from the website www.calzoleriamarini.it (hereinafter, the “Website“) in compliance with the Italian regulations set forth in Legislative Decree 206/2005 as amended and supplemented (hereinafter, “Consumer Code“).

The seller of the products and owner of the Site is: DIMAS SRL with registered office in SURBO (LE), via Ugo Foscolo 6, P.Iva ???????????. E-mail address: info@calzoleriamarini.it (hereinafter “COMPANY“).

The consumer who accesses the Site to make purchases (hereinafter “Customer“) is required, prior to placing an order, to read these Terms and Conditions that have been made available to him/her on the Site. These conditions will also be available to the Customer at any time through the link contained in the confirmation email of each order to allow him to reproduce and store them.

In the event that the person making purchases on the Site requires an invoice to be issued and/or is otherwise not a “consumer or user” as defined in Art. 3(1)(a) of the Consumer Code, the withdrawal rules in Art. 7 and 8 of these General Conditions nor, more generally, the provisions that under the same Consumer Code apply only to “consumers”.

Contracts concluded with www.calzoleriamarini.it through the Site are governed by these General Conditions in accordance with Italian law. The language available to conclude the contract is Italian.

Choosing and Ordering Products

The features and price of the various products for sale on the Site (hereinafter referred to as “Product” or “Products“) are shown on the page for each Product.

To purchase Products, the Customer must complete and submit the order form in electronic format, following the instructions on the Site. The Customer shall add the Product to the “Shopping Cart”, shall review the General Terms and Conditions and Privacy Policy confirming their acceptance. You can then enter the shipping and possible billing information, select the desired payment method, and confirm the order.

By submitting the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure and fully accepts these transcribed General and Payment Conditions.

The contract concluded between DIMAS SRL and the Customer shall be considered concluded with the acceptance of the order by DIMAS SRL. Such acceptance is communicated to the Customer through an email confirmation of the order itself containing a reference to these General Terms and Conditions. In the order confirmation email there will also be: order number, shipping and billing information, list of Products ordered with characteristics and the total price including delivery charges. The Customer will check the confirmation email and if he/she identifies errors in the order, he/she will have 12 hours from receipt of that email to contact Customer Service (contact form in the “Customer Support” or “Contact Us” section). After this time, the order will be put into processing for shipment and no further changes will be accepted, without prejudice to the Customer’s rights under Article 7 below.

Once the order is received, DIMAS SRL will check stock availability for order fulfillment. In the event that one or more Products are not available, DIMAS SRL Customer Service will promptly notify the Customer by email. The Customer, within the next 12 hours, will have the option to respond to confirm the shipment of any additional Products available or cancel the order. If no response is received within that time, the order will be considered confirmed and the available Products will be placed for shipment. In this case, the full amount for the missing Products will be reversed or otherwise, depending on the payment method chosen, the Customer will not be charged.

Product Information

Information and features related to the Products are available, with the relevant Product codes, on the Site.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products themselves is for the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In case of any difference between the picture and the written product sheet, the product sheet description shall always prevail.

Prices and shipping

Product prices include all taxes and fees. All prices are in Euros. The cost of shipping, within Italy, is always free. For orders with foreign shipments, please contact our customer care for more information.

Payment and billing arrangements

Payment methods

The Customer may make payment for the price of the Products and related delivery charges by credit card, PayPal and bank transfer.

  • Credit Card

The circuits on which it is possible to purchase within the Site are:

Visa, Visa Electron, Mastercard, American Express.

To ensure maximum security, the Customer will make the payment transaction directly on the bank’s secure server. The Site does not store the Customer’s credit card number, but thanks to the secure communication system of the credit reference institution, from the second expenditure, the Customer who wishes to do so – by selection of the appropriate option – will be able to proceed with the purchase without entering his data again. The Referring Credit Institution uses the SSL protocol to encrypt data transmitted between its server and the Client’s browser.

  • PayPal

Once the order has been confirmed, the Customer will be redirected to the PayPal website where he/she can make the payment with his/her account or by using a card, including a prepaid card, or otherwise in the manner accepted by PayPal and in accordance with its terms.

  • Bank Transfer

Once the order is confirmed, the Customer will receive a confirmation email in which the IBAN code to which the transfer should be made will be indicated.

Invoicing of orders

If the purchase is made by a professional, it will be possible to request issuance of the invoice. Simply check the appropriate box during the order process by entering the billing information including tax code and/or VAT number. In that case, the invoice will be sent via email to the address indicated. The practitioner is responsible for the correct entry of billing information and is expressly informed that if an invoice is not requested at the time of ordering, it will not be possible to request it later.

Transportation and delivery

Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase process in the appropriate “Shipping Information” field.

All purchases will be delivered by express courier (hereinafter, “Courier“) Monday through Friday, excluding holidays and national holidays. DIMAS SRL is not responsible for delays that cannot be foreseen or attributed to it. Once the products have been shipped, the Customer will receive a confirmation email including a link to refer to for tracking the shipment. In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 3 (three) weeks from the day following the day on which DIMAS SRL confirmed the order to the Customer by means of an order confirmation email.

Active delivery services in Italy:

COMPANY COURIER

The service provides 2 delivery attempts at the address given at the time of order. A notice will be left after each step. On the second unsuccessful delivery attempt, the Courier will contact the recipient of the order by telephone at the telephone number provided to arrange delivery. If untraceable or absent, the goods will return to the warehouse.

Overseas shipments may be made with different couriers depending on the country of destination in order to ensure the best available rate for the Customer.

Free return in case of exercising the right of withdrawal

As a more favorable condition for the Customer, DIMAS SRL keeps the shipping costs for the return of the Products in full at its own expense in case of exercise of the right of withdrawal. In order to benefit from such free shipping, the Customer who intends to exercise the right of withdrawal must follow the procedure indicated in Article 7 above and wait to be contacted by DIMAS SRL to arrange the return of the Products to the courier.

Warranty and Conformity Defects

The information about the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which therefore DIMAS SRL cannot be held responsible, except in cases of malice or gross negligence. DIMAS SRL reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, or to change or update information at any time without prior notice, without prejudice to the Customer’s rights under these General Terms and Conditions and the Consumer Code. Except in the case of willful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of an indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance or fulfillment, even partial, of an order, is excluded. DIMAS SRL promotes the responsible consumption of alcohol and excludes any liability on its part, except in cases of intent or gross negligence, in the case of purchases made by minors under 16 years of age.

Applicable law and jurisdiction

The contract of sale between the Client and DIMAS SRL is understood to be concluded in Italy and governed by Italian Law. For the resolution of disputes relating to the interpretation, execution or termination of these General Conditions or individual purchase orders if the Customer is a consumer under the Consumer Code, will be competent exclusively the court of his town of residence or domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of Lecce, any other jurisdiction excluded.
